OncoFirm™ Diagnostics Corporation (“OncoFirm,” “Company,” “we,” “us,” or “our”) respects the privacy of individuals who apply for employment, consulting, advisory, internship, contractor, or other professional opportunities with our Company.

This Employment Application Privacy Notice (“Applicant Privacy Notice”) explains how OncoFirm may collect, use, disclose, protect, retain, and otherwise process personal information relating to job applicants, prospective employees, consultants, contractors, advisors, interns, and other individuals seeking a professional relationship with OncoFirm (“Applicant,” “Candidate,” or “you”).

This notice applies to information submitted directly through the OncoFirm website, including résumé and CV submission forms, as well as information received through email, professional networking platforms, recruiting services, referrals, interviews, professional conferences, academic institutions, employment agencies, and other recruiting channels.

This Applicant Privacy Notice supplements OncoFirm’s general website Privacy Policy. If there is a conflict concerning information collected specifically for recruitment or employment purposes, this Applicant Privacy Notice will apply to that information to the extent permitted by applicable law.

The personal information collected by OncoFirm depends upon the position, location, stage of the recruiting process, and information voluntarily provided by the Applicant.

OncoFirm will not request salary history where doing so is prohibited by applicable law.

  • Licenses
  • Scientific qualifications
  • Technical expertise
  • Publications
  • Research experience
  • Clinical experience

  • Specialized technical skills

For scientific, clinical, engineering, regulatory, software, artificial intelligence, laboratory, and medical-device positions, we may request information relating to an Applicant’s specialized qualifications or experience relevant to the position.

D. Professional and Online Information

Applicants may voluntarily provide:

  • LinkedIn profile
  • ORCID profile
  • Professional website
  • Online portfolio
  • Google Scholar profile
  • ResearchGate profile
  • GitHub profile
  • Publication history
  • Professional biography
  • Other professional or academic profiles

Where permitted by law, OncoFirm may also review publicly available professional information that is reasonably relevant to evaluating an Applicant’s qualifications.

E. Work Eligibility Information

Depending upon the position and jurisdiction, we may ask whether an Applicant:

  • Is legally authorized to work in the applicable country;
  • Will require current or future employment sponsorship; or
  • Meets legally required licensing or professional authorization requirements.

If an individual is hired, additional documentation may be collected to verify identity and employment authorization as required by law.

F. Interview and Evaluation Information

During the recruiting process, OncoFirm may create or collect:

  • Interview notes
  • Candidate assessments
  • Interviewer feedback
  • Skills assessments
  • Technical evaluations
  • Writing samples
  • Work samples
  • Presentations
  • Responses to interview questions
  • Professional reference information
  • Recruiting correspondence
  • Candidate ranking or selection documentation
  • Internal notes concerning qualifications for the position

G. Referral Information

If an Applicant is referred to OncoFirm by another individual, university, recruiter, employee, advisor, collaborator, professional contact, or business partner, we may receive information such as:

  • Applicant’s name
  • Contact information
  • Résumé or CV
  • Professional qualifications
  • Nature of the referral
  • Referrer’s relationship with the Applicant

Applicants should ensure that professional references and other individuals whose information they provide understand that their information may be provided to OncoFirm.

H. Technical and Website Information

When an Applicant uses OncoFirm’s website or online employment forms, certain technical information may automatically be collected through our web systems, hosting providers, security systems, or analytics technologies.

This information may include:

  • IP address
  • Browser type
  • Device type
  • Operating system
  • Date and time of submission
  • Referring webpage
  • Pages visited
  • Security and anti-spam information
  • Form submission records
  • Website log information

2. Sensitive Personal Information

Certain information associated with the recruiting process may qualify as sensitive personal information under applicable laws.

Depending upon the position, jurisdiction, and stage of the hiring process, this may include information relating to:

  • Government-issued identification;
  • Employment authorization;
  • Immigration or visa status;
  • Professional licensing;
  • Background screening;
  • Demographic information voluntarily provided for legally permitted equal employment opportunity purposes;
  • Disability or accommodation information voluntarily provided when an accommodation is requested; or
  • Other information treated as sensitive under applicable law.

OncoFirm seeks to collect sensitive information only where reasonably necessary and legally permitted.

Please Do Not Submit Unnecessary Sensitive Information

Applicants should not include unnecessary sensitive personal information in a résumé, CV, cover letter, or online application.

Unless specifically requested through an appropriate secure process, please do not submit:

  • Account login credentials

  • Patient information

  • Detailed health or diagnostic information

Applicants should also refrain from submitting personally identifiable patient information or other information subject to healthcare confidentiality requirements.


3. How We Obtain Applicant Information

OncoFirm may collect Applicant Personal Information from several sources, including:

  • Other sources that you authorize or that applicable law permits us to use.

4. Why OncoFirm Uses Applicant Personal Information

We may use Applicant Personal Information for legitimate recruiting, employment, organizational, administrative, security, and legal purposes.

These purposes may include:

Recruiting and Candidate Evaluation

  • Receiving and reviewing applications;
  • Evaluating résumés and CVs;
  • Determining whether qualifications match available positions;
  • Evaluating education and professional experience;
  • Conducting interviews;
  • Assessing technical, scientific, managerial, commercial, regulatory, clinical, or other qualifications;
  • Comparing qualifications with job requirements;
  • Communicating with Applicants;
  • Scheduling interviews;
  • Checking references where authorized;
  • Making hiring or engagement decisions; and
  • Preparing and communicating employment or consulting offers.

Future Opportunities

Unless prohibited by law or an Applicant requests otherwise, OncoFirm may retain Applicant information to consider the individual for future positions that may be relevant to the Applicant’s qualifications.

Corporate and Administrative Purposes

We may process Applicant information to:

  • Operate our recruiting program;
  • Maintain recruiting records;
  • Analyze recruiting activities;
  • Improve recruitment processes;
  • Plan staffing needs;
  • Manage professional relationships;
  • Maintain appropriate business records;
  • Protect Company systems and information; and
  • Prevent fraud, misuse, cybersecurity incidents, or unauthorized access.

Legal and Regulatory Purposes

Information may also be processed when reasonably necessary to:

  • Comply with employment laws;
  • Comply with record-retention obligations;
  • Respond to government agencies;
  • Respond to legal process;
  • Establish, exercise, or defend legal claims;
  • Investigate allegations of misconduct;
  • Protect the rights and safety of OncoFirm, its personnel, Applicants, and others; and
  • Satisfy other legal or regulatory requirements.

5. Background Checks and Verification

For certain positions, OncoFirm may conduct legally permitted employment, education, licensing, credential, professional-reference, or background verification.

Any background report obtained from a third-party consumer reporting agency will be handled in accordance with applicable law.

Where the Fair Credit Reporting Act or similar state or local law applies, any legally required disclosure and authorization for a consumer or background report will be provided separately from this Employment Application Privacy Notice and separately from the employment application itself.

Submitting a résumé or employment application through the OncoFirm website does not by itself constitute authorization for a consumer-reporting background check.


6. Artificial Intelligence and Automated Employment Technologies

OncoFirm develops and works with advanced technologies as part of its business. This does not necessarily mean that artificial intelligence or automated decision-making technology is used to make employment decisions.

If OncoFirm uses an automated employment decision tool, artificial intelligence system, machine-learning system, algorithmic assessment, or similar technology in a manner that triggers disclosure, audit, consent, accommodation, opt-out, or other requirements under applicable law, OncoFirm will provide any additional notices or procedures required by that law.

Where applicable, human personnel may participate in recruiting and hiring decisions.

Nothing in this Applicant Privacy Notice should be interpreted as a statement that OncoFirm currently uses a legally defined automated employment decision tool for every or any employment position.


7. Disclosure of Applicant Personal Information

OncoFirm does not disclose Applicant Personal Information indiscriminately.

Applicant information may be disclosed where reasonably necessary to the following categories of recipients.

Within OncoFirm

Applicant information may be made available to personnel with a legitimate need to evaluate or administer an application, including:

  • Company executives;
  • Hiring managers;
  • Interviewers;
  • Human resources or recruiting personnel;
  • Department managers;
  • Legal or compliance personnel;
  • Information technology personnel;
  • Authorized consultants and advisors; and

These providers may process information only as permitted by applicable agreements and law.

Professional Advisors

Where appropriate, information may be disclosed to:

Government or Legal Authorities

Corporate Transactions

If OncoFirm participates in a financing, investment, merger, acquisition, restructuring, reorganization, sale of assets, due diligence process, or similar transaction, Applicant information may be disclosed where reasonably necessary and subject to appropriate confidentiality and legal protections.


8. Sale and Advertising Use of Applicant Information

OncoFirm does not intend to sell Applicant résumés, CVs, employment applications, or recruiting information for monetary consideration.

Applicant information submitted for recruiting purposes is not intended to be used by OncoFirm for third-party behavioral advertising.

Website analytics, cookie technologies, and other website-related information may be subject to OncoFirm’s general Privacy Policy and applicable privacy choices.

Where applicable law defines the terms “sell” or “share” more broadly than their ordinary meaning, OncoFirm will provide applicable disclosures and privacy choices as required by law.


9. Data Security

OncoFirm takes reasonable administrative, technical, organizational, and physical measures designed to protect Applicant Personal Information from unauthorized access, acquisition, destruction, alteration, disclosure, loss, or misuse.

These protections may include, as appropriate:

  • Access controls;
  • Authentication controls;
  • Password-protected systems;
  • Network and endpoint security;
  • Restricted access to recruiting information;
  • Secure hosting systems;
  • Malware and threat protection;
  • Backup systems;
  • Vendor security requirements; and
  • Administrative procedures for handling personal information.

No website, email system, cloud service, or electronic storage system can be guaranteed to be completely secure. Applicants should therefore avoid submitting information that OncoFirm has not requested.


10. Retention of Applicant Information

OncoFirm retains Applicant Personal Information only for as long as reasonably necessary for recruiting, employment, regulatory, recordkeeping, legal, security, and legitimate business purposes.

Retention periods may vary depending upon:

  • The Applicant’s jurisdiction;
  • The type of position;
  • Whether the Applicant is hired;
  • Applicable employment-record requirements;
  • The nature of the information;
  • Ongoing recruiting needs;
  • Potential future positions;
  • Contractual requirements;
  • Government requirements;
  • Litigation or legal holds; and
  • Applicable statutes of limitation.

Unless a different period is required by law or circumstances, OncoFirm may generally retain unsuccessful Applicant records for up to four years following the relevant application or hiring decision.

Where applicable law requires a longer retention period, records may be retained for that longer period.

If an Applicant becomes an employee, consultant, contractor, officer, advisor, or other Company personnel, information collected during recruitment may become part of the individual’s personnel or professional relationship records and will be retained in accordance with the applicable Company record-retention practices.

Records subject to litigation, regulatory investigation, government inquiry, complaint, audit, subpoena, or legal hold may be retained until the relevant matter has been finally resolved.


11. Applicant Privacy Rights

Depending upon where an Applicant resides and applicable privacy laws, the Applicant may have certain rights regarding personal information.

These rights may include the right to:

  • Request information concerning personal information collected about you;
  • Request access to certain personal information;
  • Request correction of inaccurate personal information;
  • Request deletion of certain personal information;
  • Obtain information concerning categories of information collected;
  • Obtain information concerning purposes for which information is used;
  • Obtain information concerning categories of recipients;
  • Request restriction or limitation of certain uses of sensitive personal information where applicable;
  • Opt out of certain legally defined sales or sharing of personal information, where applicable;
  • Request a portable copy of certain information where applicable; and
  • Exercise privacy rights without unlawful discrimination or retaliation.

These rights are subject to exceptions, limitations, verification requirements, record-retention obligations, and other provisions of applicable law.

For example, OncoFirm may be required to retain certain employment application records even after receiving a deletion request.


12. California Applicants

If you are a California resident and the California Consumer Privacy Act (“CCPA”), as amended, applies to OncoFirm’s processing of your information, you may have additional rights relating to Applicant Personal Information.

Depending upon applicability and legal exceptions, these may include rights to:

  • Know what categories of personal information are collected;
  • Know the purposes for collection and use;
  • Know categories of sources;
  • Know categories of third parties or service providers to whom information is disclosed;
  • Access certain personal information;
  • Request correction;
  • Request deletion;
  • Opt out of certain sales or sharing;
  • Limit certain uses of sensitive personal information where the statutory right applies; and
  • Receive non-discriminatory treatment for exercising applicable privacy rights.

The categories of information that OncoFirm may collect from Applicants and the purposes for using that information are described throughout this Notice.

OncoFirm may retain Applicant information when retention is reasonably necessary or legally required, including to comply with employment-record-retention requirements.

If OncoFirm is not subject to a particular provision of the CCPA, the inclusion of this section does not create rights beyond those required by applicable law.


13. New York Applicants

OncoFirm is headquartered in New York and maintains administrative, technical, and physical safeguards designed to protect covered private information in accordance with applicable New York data-security requirements.

Applicants should not submit Social Security numbers, financial-account information, login credentials, or other highly sensitive information through the general résumé submission form unless OncoFirm specifically requests the information through an appropriate process.


14. New York City Applicants and Automated Employment Decision Tools

New York City imposes specific requirements concerning certain legally defined Automated Employment Decision Tools (“AEDTs”).

If OncoFirm uses an AEDT in circumstances covered by New York City law, OncoFirm will provide any notice, bias-audit information, data information, accommodation information, or other disclosures required by applicable law.

This section does not state that OncoFirm currently uses an AEDT in connection with a particular position.


15. International Applicants

Applicants outside the United States may be subject to additional national or regional privacy laws.

Where applicable, OncoFirm may provide a supplemental privacy notice concerning international data transfers, lawful bases for processing, additional rights, or other jurisdiction-specific requirements.

By applying for a position with a United States-based company, an Applicant understands that information may be processed or stored in the United States, subject to applicable law and appropriate safeguards.


16. Information About Other Individuals

If you provide personal information concerning another individual, including a professional reference, colleague, former supervisor, academic advisor, collaborator, or other contact, you should have an appropriate basis to provide that information to OncoFirm.

Please provide only information that is reasonably relevant to your application.


17. Children and Minors

OncoFirm’s employment and professional recruiting services are not intended for children.

Applicants should be of an appropriate legal age to seek the position or professional opportunity for which they are applying.

Where internships or educational programs may involve minors, OncoFirm will handle applicable information in accordance with relevant legal and program requirements.


18. Equal Employment Opportunity Information

Where legally permitted or required, OncoFirm may invite Applicants to voluntarily provide demographic or equal-employment-opportunity information.

Where such information is collected:

  • Providing it is voluntary unless otherwise required by law;
  • It will be handled in accordance with applicable legal requirements;
  • It will be used for legally permitted purposes; and
  • It should be maintained separately from information used by hiring personnel when required by law.

OncoFirm does not intend to use protected personal characteristics as a basis for unlawful employment discrimination.

Résumés, CVs, cover letters, and other Applicant documents submitted through the OncoFirm website may contain substantial personal information.

Applicants should carefully review documents before uploading them and remove information that is unnecessary for evaluating professional qualifications.

Applicants are specifically encouraged to remove:

  • Social Security numbers;
  • Government identification numbers;
  • Financial information;
  • Account credentials;
  • Unnecessary birth dates;
  • Medical records;
  • Patient information; and
  • Confidential information belonging to third parties.

Submission of proprietary information belonging to a current or former employer is prohibited unless the Applicant has lawful authority to disclose that information.


21. Changes to This Applicant Privacy Notice

OncoFirm may update this Applicant Privacy Notice periodically to reflect changes in:

  • Recruiting practices;
  • Technology;
  • Legal requirements;
  • Data-processing activities;
  • Company operations; or
  • Privacy and security practices.

When material changes are made, the “Last Updated” date at the beginning of this Notice will be revised.

Where legally required, additional notice regarding material changes may be provided.

Applicants are encouraged to review the current version of this Notice when submitting an application.

  • Employment;
  • Consulting work;
  • Advisory appointment;
  • Internship;
  • Contractor engagement; or
  • Future consideration.

OncoFirm reserves the right to determine its staffing, recruiting, interviewing, and selection needs subject to applicable law.


24. Applicant Acknowledgment

By submitting an application, résumé, CV, or other recruiting information to OncoFirm, you acknowledge that you have been provided access to this Employment Application Privacy Notice and understand that OncoFirm may process Applicant Personal Information as described in this Notice and as otherwise permitted or required by applicable law.

Where consent or separate authorization is legally required for a particular processing activity, OncoFirm will seek that consent or authorization separately.
